A plain reading of a Pennsylvania statute and a little common sense helped four attorneys from Montgomery McCracken Walker & Rhoads LLP secure a decision from the state supreme court that the Pennsylvania Liquor Control Board had to implement direct delivery of specialty wine and liquor to consumers.

“It was a straightforward interpretation of a couple sentences in the statute, plus some common sense,” John Papianou, partner and litigation chair for Montgomery McCracken, told Law360 Pulse. “The outcome was clear. The PLCB had to really reach to come up with an interpretation that was in their favor.”

Papianou led the argument with Joseph E. Samuel Jr., an associate in the firm’s Philadelphia office. The team was rounded out by Of Counsel Patrick T. Ryan and associate Robert E. Day. Oral arguments were presented via livestream to the Commonwealth Court in April 2020 in the first case to use remote technology in Pennsylvania’s appellate courts during the Covid-19 pandemic.
