Firm adds partner and associate to its Litigation Department
PHILADELPHIA – Montgomery McCracken is pleased to announce the additions of Richard M. Simins and Jackson E. Warren to its Litigation Department in Philadelphia. Simins rejoins the firm as a partner and Warren joins as an associate. Simins was formerly with Montgomery McCracken from 1989 to 2001.

Simins is an accomplished commercial trial attorney with more than 25 years of diverse experience ranging across the entire civil litigation spectrum. A sampling of his engagements includes trial of an M&A fraud and trade secrets case for a major supplier of health analytics data to the pharmaceutical industry; defending a national office services company in multiple trademark infringement litigations across the country arising from the company’s name change; winning a breach of contract trial against a commodities brokerage house on behalf of a multinational steel company; winning summary judgment for a consumer products name-brand manufacturer in a toxic tort class action; trial of a complex fraud case defending a national provider of intraoperative neuromonitoring services; successfully defending a prominent Philadelphia area real estate developer against civil RICO charges; False Claims Act (qui tam) litigation involving the sale of durable medical equipment to the US government; obtaining favorable settlement of a hybrid collective/class action under FLSA and state labor statutes for a well-known home health care company; and anti-kickback fraud litigation representing a hospital and ambulatory surgery center management company against a major insurer. In the healthcare arena, Simins has litigated reimbursement disputes on the payor and payee side, HIPAA compliance and privacy infringement cases, Medicare fraud and abuse claims, provider credentialing issues and ERISA benefit claims, in addition to handling a variety of contract-related matters such as between insurance companies and third-party administrators, providers and rental networks, and provider organizations and participating physicians/staff.
Simins received his J.D. from Columbia Law School in 1988, where he was Senior Editor of the Columbia Law Review. He earned a B.A. from Princeton University in 1978. Prior to law school, Simins spent seven years as a professional writer in New York City. He served as law clerk to the Honorable Marvin Katz (U.S. District Court for the Eastern District of Pennsylvania) in 1988-89.
Joining Simins is associate Jackson E. Warren. Warren received a J.D. degree from University of Pennsylvania Law School in 2015. Warren is a classical musician and holds degrees in orchestra conducting and double bass, receiving his D.M.A. from the University of Arizona in 2012 and his M.M. from the University of Cincinnati in 2007. He received his B.M. from Rice University in 2004.
